These Terms of Service (“Terms”) govern your access to and use of Tago, also known as Maklom (the “Service”), a Go/Baduk tournament management platform operated by Trinity Go Academy (“we”, “us”, “our”). The Service includes the public website, the signed-in player portal, the live tournament boards, the LINE mini app, and the organizer/referee tools.

By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

• You must be able to enter a binding agreement under Thai law, or use the Service with the consent and supervision of a parent or legal guardian.
• Many tournament participants are school-age students. Where a player is a minor, their parent or guardian is responsible for that player’s account and for supervising their use of the Service.
• Organizers and referees are appointed by the tournament organizer. Holding an account does not by itself grant any organizer or referee permission.

2. Accounts and sign-in

• Identity and sign-in are provided by Clerk. You sign in with a LINE account. Your use of LINE is also subject to LINE’s own terms.
• You are responsible for everything that happens under your account. Keep your LINE credentials secure and tell us promptly if you suspect unauthorised access.
• You must provide accurate information (for example your name, contact details, and affiliation) and keep it up to date. Organizers rely on this information to run tournaments fairly.
• One person, one account. Do not impersonate another person or register on someone else’s behalf without authority to do so.

3. Roles and permissions

The Service assigns each signed-in user a role: General, Player, Parent, Referee, or Organizer. What you can see and do depends on your role and is enforced on our servers. Roles may be granted, changed, or revoked by the tournament organizer or by us. You must not attempt to exercise permissions your role does not grant.

4. Tournament data and its display

The Service exists to run and publish tournaments. You acknowledge and agree that:

• Player names, affiliation (school or club), rank, division, table assignments, pairings, results, standings, and tournament history are displayed on the live boards, results pages, and applicant lists to anyone who is signed in to the Service, during and after a tournament. Tournament organizers may also display or print this information at the venue.
• Referees may attach photographic evidence of a result (for example a photo of the final board position or scoring sheet). Such photos may be shown alongside the published result.
• Published results form part of the permanent record of a tournament and may remain available after the event ends.
• Contact details such as phone numbers, email addresses, and LINE identifiers are never displayed to other users.

5. Acceptable use

You agree not to:

• submit false results, tamper with pairings, or otherwise interfere with the fair running of a tournament;
• access, or attempt to access, data or functions not intended for your role;
• scrape, bulk-download, or redistribute personal data from the Service beyond what is necessary to follow a tournament;
• upload content that is unlawful, abusive, or infringes another person’s rights, including photos of people taken without appropriate permission;
• probe, disrupt, overload, or reverse-engineer the Service or its infrastructure;
• use the Service for any purpose other than participating in, officiating, organizing, or following Go/Baduk tournaments.

6. Content you provide

You keep ownership of content you upload (such as a profile photo or a result photo). You grant Trinity Go Academy and the tournament organizer a worldwide, royalty-free licence to store, display, and reproduce that content as needed to operate the Service, publish tournament results, and maintain the tournament record. You confirm you have the right to upload the content and, where it depicts other people, that you have their permission.

7. Notifications

You may opt in to email and/or LINE notifications about tournaments you are involved in (for example pairing announcements or result confirmations). You can change these preferences in your profile at any time. LINE notifications are delivered through LINE’s messaging platform and are subject to LINE’s availability.

8. Organizer responsibilities

If you use the Service as an organizer or referee, you additionally agree to: import and enter only data you are authorised to process; obtain any consent required from participants or their guardians before registering them; keep result entries accurate; and use organizer tools solely for the tournament you are running.

9. Intellectual property

The Service, including its software, design, pairing engine, and branding, is owned by Trinity Go Academy and protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.

10. Availability and changes to the Service

We aim to keep the Service available, especially on tournament days, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. Where reasonably possible we will give notice of significant changes.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. Pairings, standings, and results shown in the Service are operational information; the tournament organizer’s official ruling prevails in any dispute.

12. Limitation of liability

To the fullest extent permitted by law, Trinity Go Academy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or opportunity, arising from your use of or inability to use the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for wilful misconduct or gross negligence.

13. Suspension and termination

We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the integrity of a tournament. You may stop using the Service at any time and may request deletion of your account as described in the Privacy Policy. Published tournament results may be retained as part of the historical record even after an account is deleted.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows the current version. If a change is material we will notify you through the Service or by email before it takes effect. Continued use after the effective date constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute shall be subject to the jurisdiction of the courts of Thailand.

16. Language

These Terms are provided in English and Thai. In case of any inconsistency between the two versions, the Thai version shall prevail.

1. ผู้ที่สามารถใช้บริการได้

• ท่านต้องมีความสามารถในการทำนิติกรรมตามกฎหมายไทย หรือใช้บริการโดยได้รับความยินยอมและอยู่ภายใต้การดูแลของบิดามารดาหรือผู้ปกครองตามกฎหมาย
• ผู้เข้าร่วมการแข่งขันจำนวนมากเป็นนักเรียนที่ยังไม่บรรลุนิติภาวะ ในกรณีที่ผู้เล่นเป็นผู้เยาว์ บิดามารดาหรือผู้ปกครองต้องรับผิดชอบต่อบัญชีของผู้เล่นและกำกับดูแลการใช้บริการ
• ผู้จัดการแข่งขันและกรรมการได้รับการแต่งตั้งโดยผู้จัดการแข่งขัน การมีบัญชีเพียงอย่างเดียวไม่ได้ให้สิทธิ์ผู้จัดหรือกรรมการแต่อย่างใด

2. บัญชีและการเข้าสู่ระบบ

• การยืนยันตัวตนและการเข้าสู่ระบบให้บริการโดย Clerk ท่านเข้าสู่ระบบด้วยบัญชี LINE การใช้งาน LINE อยู่ภายใต้ข้อกำหนดของ LINE ด้วย
• ท่านรับผิดชอบต่อทุกการกระทำที่เกิดขึ้นภายใต้บัญชีของท่าน โปรดรักษาข้อมูลรับรองบัญชี LINE ให้ปลอดภัย และแจ้งเราโดยเร็วหากสงสัยว่ามีการเข้าถึงโดยไม่ได้รับอนุญาต
• ท่านต้องให้ข้อมูลที่ถูกต้อง (เช่น ชื่อ ข้อมูลติดต่อ และสังกัด) และปรับปรุงให้เป็นปัจจุบัน ผู้จัดการแข่งขันอาศัยข้อมูลนี้ในการดำเนินการแข่งขันอย่างเป็นธรรม
• หนึ่งคนต่อหนึ่งบัญชี ห้ามแอบอ้างเป็นบุคคลอื่นหรือลงทะเบียนแทนบุคคลอื่นโดยไม่มีอำนาจ

3. บทบาทและสิทธิ์

บริการกำหนดบทบาทให้ผู้ใช้ที่เข้าสู่ระบบแต่ละราย ได้แก่ ทั่วไป ผู้เล่น ผู้ปกครอง กรรมการ หรือผู้จัด สิ่งที่ท่านเห็นและทำได้ขึ้นอยู่กับบทบาทและถูกบังคับใช้ที่เซิร์ฟเวอร์ของเรา ผู้จัดการแข่งขันหรือเราอาจให้ เปลี่ยน หรือเพิกถอนบทบาทได้ ท่านต้องไม่พยายามใช้สิทธิ์ที่บทบาทของท่านไม่ได้ให้ไว้

4. ข้อมูลการแข่งขันและการแสดงผล

บริการนี้มีขึ้นเพื่อดำเนินการและเผยแพร่การแข่งขัน ท่านรับทราบและตกลงว่า:

• ชื่อผู้เล่น สังกัด (โรงเรียนหรือชมรม) ระดับฝีมือ รุ่นการแข่งขัน หมายเลขโต๊ะ การจับคู่ ผลการแข่งขัน อันดับ และประวัติการแข่งขัน จะแสดงบนกระดานถ่ายทอดสด หน้าผลการแข่งขัน และรายชื่อผู้สมัคร แก่ผู้ใช้ทุกคนที่เข้าสู่ระบบบริการ ทั้งระหว่างและหลังการแข่งขัน ผู้จัดการแข่งขันอาจแสดงหรือพิมพ์ข้อมูลนี้ ณ สถานที่แข่งขันด้วย
• กรรมการอาจแนบภาพถ่ายหลักฐานผลการแข่งขัน (เช่น ภาพกระดานตอนจบเกมหรือใบบันทึกคะแนน) ภาพดังกล่าวอาจแสดงร่วมกับผลการแข่งขันที่เผยแพร่
• ผลการแข่งขันที่เผยแพร่เป็นส่วนหนึ่งของบันทึกถาวรของการแข่งขัน และอาจยังคงเข้าถึงได้หลังการแข่งขันสิ้นสุด
• ข้อมูลติดต่อ เช่น หมายเลขโทรศัพท์ อีเมล และตัวระบุ LINE จะไม่ถูกแสดงต่อผู้ใช้รายอื่น

5. การใช้งานที่ยอมรับได้

ท่านตกลงว่าจะไม่:

• ส่งผลการแข่งขันที่เป็นเท็จ แก้ไขการจับคู่โดยมิชอบ หรือแทรกแซงการดำเนินการแข่งขันอย่างเป็นธรรมด้วยวิธีอื่นใด
• เข้าถึงหรือพยายามเข้าถึงข้อมูลหรือฟังก์ชันที่ไม่ได้มีไว้สำหรับบทบาทของท่าน
• ดึงข้อมูล ดาวน์โหลดจำนวนมาก หรือเผยแพร่ข้อมูลส่วนบุคคลจากบริการซ้ำเกินกว่าที่จำเป็นในการติดตามการแข่งขัน
• อัปโหลดเนื้อหาที่ผิดกฎหมาย ก้าวร้าว หรือละเมิดสิทธิ์ของบุคคลอื่น รวมถึงภาพถ่ายบุคคลที่ถ่ายโดยไม่ได้รับอนุญาตอย่างเหมาะสม
• ตรวจสอบช่องโหว่ ขัดขวาง สร้างภาระเกินควร หรือทำวิศวกรรมย้อนกลับบริการหรือโครงสร้างพื้นฐาน
• ใช้บริการเพื่อวัตถุประสงค์อื่นนอกจากการเข้าร่วม ตัดสิน จัด หรือติดตามการแข่งขันหมากล้อม

6. เนื้อหาที่ท่านให้ไว้

ท่านยังคงเป็นเจ้าของเนื้อหาที่ท่านอัปโหลด (เช่น รูปโปรไฟล์หรือภาพถ่ายผลการแข่งขัน) ท่านให้สิทธิ์แก่ Trinity Go Academy และผู้จัดการแข่งขันในการจัดเก็บ แสดง และทำซ้ำเนื้อหานั้นทั่วโลกโดยไม่มีค่าสิทธิ ตามที่จำเป็นเพื่อดำเนินการบริการ เผยแพร่ผลการแข่งขัน และรักษาบันทึกการแข่งขัน ท่านยืนยันว่ามีสิทธิ์อัปโหลดเนื้อหาดังกล่าว และหากเนื้อหาแสดงภาพบุคคลอื่น ท่านได้รับอนุญาตจากบุคคลนั้นแล้ว

7. การแจ้งเตือน

ท่านสามารถเลือกรับการแจ้งเตือนทางอีเมลและ/หรือ LINE เกี่ยวกับการแข่งขันที่ท่านมีส่วนร่วม (เช่น ประกาศการจับคู่หรือการยืนยันผล) ท่านสามารถเปลี่ยนการตั้งค่านี้ได้ในหน้าโปรไฟล์ทุกเมื่อ การแจ้งเตือนทาง LINE ส่งผ่านแพลตฟอร์มข้อความของ LINE และขึ้นอยู่กับความพร้อมใช้งานของ LINE

8. ความรับผิดชอบของผู้จัด

หากท่านใช้บริการในฐานะผู้จัดหรือกรรมการ ท่านตกลงเพิ่มเติมว่าจะ: นำเข้าและบันทึกเฉพาะข้อมูลที่ท่านมีอำนาจประมวลผล; ขอความยินยอมที่จำเป็นจากผู้เข้าร่วมหรือผู้ปกครองก่อนลงทะเบียน; บันทึกผลการแข่งขันอย่างถูกต้อง; และใช้เครื่องมือผู้จัดเฉพาะสำหรับการแข่งขันที่ท่านดำเนินการเท่านั้น

9. ทรัพย์สินทางปัญญา

บริการ รวมถึงซอฟต์แวร์ การออกแบบ ระบบจับคู่ และตราสินค้า เป็นของ Trinity Go Academy และได้รับความคุ้มครองตามกฎหมายลิขสิทธิ์และกฎหมายอื่น เราให้สิทธิ์แก่ท่านอย่างจำกัด ไม่ผูกขาด ไม่สามารถถ่ายโอน และเพิกถอนได้ ในการใช้บริการตามข้อกำหนดนี้ ไม่มีการให้สิทธิ์อื่นใด

10. ความพร้อมใช้งานและการเปลี่ยนแปลงบริการ

เรามุ่งมั่นให้บริการพร้อมใช้งาน โดยเฉพาะในวันแข่งขัน แต่ไม่รับประกันว่าบริการจะไม่หยุดชะงักหรือปราศจากข้อผิดพลาด เราอาจแก้ไข ระงับ หรือยุติส่วนใดของบริการได้ทุกเมื่อ และจะแจ้งล่วงหน้าสำหรับการเปลี่ยนแปลงสำคัญเท่าที่ทำได้ตามสมควร

11. ข้อสงวนสิทธิ์

บริการให้ไว้ “ตามสภาพ” และ “ตามที่มีอยู่” เท่าที่กฎหมายอนุญาต เราปฏิเสธการรับประกันทั้งหมดไม่ว่าโดยชัดแจ้งหรือโดยปริยาย รวมถึงความเหมาะสมสำหรับวัตถุประสงค์เฉพาะ การจับคู่ อันดับ และผลที่แสดงในบริการเป็นข้อมูลเชิงปฏิบัติการ คำวินิจฉัยอย่างเป็นทางการของผู้จัดการแข่งขันถือเป็นที่สุดในกรณีมีข้อพิพาท

12. ข้อจำกัดความรับผิด

เท่าที่กฎหมายอนุญาต Trinity Go Academy จะไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายอันเนื่องมาจากอุบัติการณ์ ความเสียหายพิเศษ ความเสียหายสืบเนื่อง หรือค่าเสียหายเชิงลงโทษ หรือต่อการสูญเสียข้อมูลหรือโอกาสใดๆ อันเกิดจากการใช้หรือการไม่สามารถใช้บริการ ทั้งนี้ ไม่มีข้อความใดในข้อกำหนดนี้จำกัดความรับผิดที่ไม่อาจจำกัดได้ตามกฎหมาย รวมถึงความรับผิดจากการกระทำโดยจงใจหรือประมาทเลินเล่ออย่างร้ายแรง

13. การระงับและการยุติ

เราอาจระงับหรือยุติการเข้าถึงของท่านหากท่านละเมิดข้อกำหนดนี้ หากกฎหมายกำหนด หรือเพื่อคุ้มครองความสุจริตของการแข่งขัน ท่านสามารถเลิกใช้บริการได้ทุกเมื่อและอาจขอลบบัญชีตามที่ระบุในนโยบายความเป็นส่วนตัว ผลการแข่งขันที่เผยแพร่แล้วอาจถูกเก็บรักษาไว้เป็นบันทึกทางประวัติศาสตร์แม้หลังจากลบบัญชีแล้ว

14. การเปลี่ยนแปลงข้อกำหนด

เราอาจปรับปรุงข้อกำหนดนี้เป็นครั้งคราว วันที่ “ปรับปรุงล่าสุด” ด้านบนแสดงฉบับปัจจุบัน หากมีการเปลี่ยนแปลงสำคัญ เราจะแจ้งท่านผ่านบริการหรือทางอีเมลก่อนมีผลบังคับใช้ การใช้บริการต่อไปหลังวันที่มีผลบังคับใช้ถือเป็นการยอมรับ

15. กฎหมายที่ใช้บังคับ

ข้อกำหนดนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทใดๆ ให้อยู่ในเขตอำนาจของศาลไทย

16. ภาษา

ข้อกำหนดนี้จัดทำเป็นภาษาอังกฤษและภาษาไทย ในกรณีที่มีความไม่สอดคล้องกันระหว่างสองฉบับ ให้ถือฉบับภาษาไทยเป็นหลัก
